Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Additional agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract and these goods, digital content and/or services are supplied by the trader or by a third party on the basis of an agreement between that third party and the trader;

Cooling-off period: the period within which the consumer may exercise the right of withdrawal;

Consumer: the natural person who does not act for purposes related to his trade, business, craft or profession;

Day: calendar day;

Digital content: data produced and supplied in digital form;

Continuous performance contract: a contract providing for the regular supply of goods, services and/or digital content over a specified period;

Durable data carrier: any means, including email, that enables the consumer or trader to store information addressed personally to him in a way accessible for future consultation for a period appropriate to the purpose and which allows unchanged reproduction;

Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period;

Trader: the natural or legal person who is a member of Thuiswinkel.org and offers products, (access to) digital content and/or services to consumers at a distance;

Distance contract: a contract concluded between the trader and consumer within an organised system for distance sales using one or more techniques for distance communication;

Model withdrawal form: the European model withdrawal form included in Annex I;

Means of distance communication: any means that can be used to conclude a contract without the consumer and trader being in the same place at the same time.

Article 3 – Applicability

These terms apply to every offer made by the trader and to every distance contract concluded between trader and consumer.

Before concluding the distance contract, the text of these terms shall be made available. If this is not reasonably possible, the trader shall indicate how the terms can be inspected and that they will be provided free of charge upon request.

If the contract is concluded electronically, the terms may be made available electronically in such a way that they can be stored on a durable medium.

If specific product or service conditions also apply, the consumer may rely on the provision most favourable to him in case of conflicting terms.

Article 4 – The offer

If an offer has a limited period of validity or is subject to conditions, this shall be explicitly stated.

The offer contains a complete and accurate description of the products, digital content and/or services offered.

Images used are a true representation. Obvious errors or mistakes do not bind the trader.

Each offer provides clear information about the rights and obligations attached to acceptance.

Article 5 – The contract

The contract is concluded when the consumer accepts the offer and fulfils the conditions set.

If accepted electronically, the trader confirms receipt without delay. Until confirmation, the consumer may dissolve the contract.

The trader takes appropriate security measures for electronic data transfer and payment.

The trader may verify whether the consumer can meet payment obligations and may refuse or impose conditions if justified.

Upon delivery, the consumer receives:

– trader contact details;

– withdrawal conditions or limitation notice;

– warranty and service information;

– total price incl. taxes and delivery costs;

– termination conditions for long-term contracts;

– withdrawal form where applicable.

For continuous contracts, this applies only to the first delivery.

Article 6 – Right of withdrawal

Products:

The consumer may withdraw within 14 days without giving reasons.

A steering angle sensor installation manual cannot be returned. A €20 handling fee plus shipping costs will always be charged.

The cooling-off period starts the day after receipt of the product(s).

Services and digital content (non-physical):

Withdrawal is possible within 14 days after conclusion of the contract.

Extended withdrawal applies if mandatory information was not provided.

Article 7 – Consumer obligations during the cooling-off period

The consumer must handle the product with care and may only inspect it as in a physical store.

The consumer is liable for diminished value caused by improper handling.

No liability applies if withdrawal information was not provided.

Article 8 – Exercising the right of withdrawal

Withdrawal must be communicated within the cooling-off period.

Products must be returned within 14 days, including accessories and original packaging if reasonably possible.

Return shipping costs are borne by the consumer unless stated otherwise.

If services were started upon explicit request, proportional costs may be charged.

All additional contracts are dissolved upon withdrawal.

Article 9 – Trader obligations upon withdrawal

The trader confirms receipt of withdrawal electronically.

All payments including delivery costs are refunded within 14 days, using the same payment method.

Extra delivery costs for premium shipping are not refunded.

Article 10 – Exclusion of withdrawal

The right of withdrawal is excluded for:

– market-dependent price products;

– public auction purchases;

– fully performed services with prior consent;

– custom-made products;

– irreversibly mixed products;

– digital content supplied with prior consent.

Article 11 – Price

Prices remain unchanged during the validity period except VAT changes.

Variable pricing due to market fluctuations is permitted if stated.

Prices include VAT.

Article 12 – Compliance and additional warranty

Products and services comply with the contract and legal requirements.

Additional warranties never limit statutory consumer rights.

Article 13 – Delivery and execution

Orders are executed with due care and within 30 days unless agreed otherwise.

Delays give the consumer the right to dissolve the contract without costs.

Risk transfers upon delivery to the consumer.

Article 15 – Payment

Payments must be made within 14 days.

Advance payment may not exceed 50%.

Late payments may incur statutory interest and collection costs.

Article 16 – Complaints procedure

Complaints must be submitted promptly and clearly.

Complaints are answered within 14 days.

Consumers may also submit complaints via Thuiswinkel.org.

Article 17 – Disputes

Dutch law applies.

Disputes may be submitted to the Thuiswinkel Disputes Committee.

Article 18 – Warranty

1 year warranty on refurbished parts.

2 years on new parts.

Wear parts: max. 40,000 km or 1 year, whichever occurs first.

Article 19 – Additional provisions

Deviations must not disadvantage the consumer and must be recorded in writing.
